If an attempt to change At Grade Crossings to a bridge or other vertical structure, the Phoenix-Mesa Gateway Airport would object. While we are okay with proposed UP track extension, there are some significant concerns. Issue 1- Current railroad crossing at Germann and Sossaman is a traffic jam. Majority of the traffic turns left from Germann to Sossaman but there is no light because of the railroad crossing. Solution 1 - During construction, UP should improve the intersection at Germann and Sossaman to provide a traffic light to better manage traffic. Issue 2 - The proposed plan requires two additional railroad crossings - one on Pecos and one on Sossaman. If trains are not coordinated well, they would effectively block the entire access to Gilbert, Chandler and 202. Today, I've been blocked for 10 to 20 mins waiting for trains to pass on Sossaman and Power. The new crossings will cause more traffic congestion. Solution 2 - Limit train activity on new extension when vehicle traffic is light. Also adding traffic lights will help this situation at Germann and Sossaman. Issue 3 - With current crossing at Germann and Sossaman, trains blow their horns as needed - and the trains travel during early mornings to avoid traffic. Adding additional crossings will increase trains horns. Just outside the industrial areas there are several housing developments where the train horns are already loud in the middle of the night. Solution 3 - Require UP to upgrade crossing at Germann and Sossaman - and the new crossings (Pecos and Sossaman) to be "Quiet Zone". The "Quiet Zone" will reduce the train noise significantly - especially in the middle of the night - for the residential neighborhoods. Respectfully, Joel RosenbergerQueen Creek, AZ

I have reviewed the revised report and attachments and SRP concurs with the finding of adverse effect, NRHP eligibility determinations, need for additional surveys, and expansions of archaeological site boundaries described. We would appreciate a copy of the GIS shapefile/geodatabase of the revised site locations, as SRP has a number of ongoing power projects in this area. Also, please note that a number of SRP transmission and distribution facilities are described as Isolated Occurrences of Cultural Materials on page 85 of the report. Specifically, Isolated Features 28, 29, 30, and 31 are in-use modern maintained SRP Critical Energy Infrastructure and need not be recorded as cultural resources or evaluated for NRHP eligibility. (printed as 9/19/2022)CommentIn regards to the letter requesting comments that our office received from Danielle Gosselin, Director, Office of Environmental Analysis, dated September 1, 2022, the Flood Control District of Maricopa County (District) has no comment on the Area of Potential Effects revisions, the adequacy of the Class III Cultural Resources Survey, OEA’s NRHP eligibility determinations, treatment recommendations, finding of adverse effect, or development of a Memorandum of Agreement as an appropriate Section 106 agreement document for the Union Pacific Railroad Company Pecos Industrial Rail Access and Train Extension Project (Surface Transportation Board Docket No. FD 36501). It appears that the rail alignment may impact the existing Rittenhouse Channel that is owned and maintained by the District. If so, a right of way use permit and a land right must be obtained from our office prior to any construction that impacts our project. Our right of way permit review will be conducted to ensure that the channel function remains fully intact and there is a clear understanding of future responsibilities for operation and maintenance of any facilities that may impact our channel. An engineering firm on behalf of Union Pacific Railroad submitted a general concept plan to the District and applied for a right of way use permit from our office in late September 2021. More detailed plans will be required before permitting decisions can be made. In addition to a right of way use permit and land right, a floodplain use permit from our office may also be necessary as the existing flood channel contains a delineated floodplain that may be impacted, and the District is responsible for floodplain reviews in the City of Mesa. The noise contours are from 2017 and are our planning scenario noise contours, so they will not be changed for some time. Those are attached as a projected GIS shapefile. The others are PDF documents. I’m hoping that meets your intended needs. A GIS Tech could georeference the PDF images in to overlay on any maps you might want to include them on as they are a combination of GIS and CAD data layers. The forecast is from the FAA’s Terminal Area Forecast, which is updated annually. Adjustments were made after 2020 to account for the pandemic and recovery. I would focus on the ‘Enplanements’ ‘Total’ and you can double that number to estimate the total passengers served as it is close to a 50/50 split. For operations (takeoffs and landings) you can use the ‘Total Ops’ column. Also, below are a few links to information on the FAA’s Part 77 and 7460 evaluation process. New railways in proximity to airports do meet the criteria to file an evaluation and they will typically set the elevation of the railcars above the track at 23’ unless another height is known. New users may need to set up a quick profile with the FAA with the link below when filing any cases. As mentioned, if there are other structures that may be needed, such as light poles or crossing lift gates, we can model some heights in software here to see if an airspace penetration would be expected. The SE Mesa Plan used the regional model to help us prioritize CIP projects for the area. Many projects identified are programmed into our CIP. Regarding the Willis Road graphic, the dashed line is what shows up in our planning documents, but to remove another at-grade crossing of PIRATE the City of Mesa developed this plan for Willis Road. (printed as 1/12/2022)CommentEI-31839City of MesaThe Pecos Industrial Rail Access and Train Extension (PIRATE) Project is a public/private initiative to invest in American high-skilled manufacturing jobs while reducing greenhouse gas emissions and local air pollution by taking over 29,000 truckloads off U.S. highways and local roadways each year. The City of Mesa, and numerous other public and private stakeholders, have worked closely with Union Pacific Railroad for several years to collaborate on this project. The City of Mesa and our technical staff are working diligently with Union Pacific's engineering and design team to coordinate the execution of this project, which entails several city processes and approvals that must be obtained for the project to advance. Union Pacific must obtain Right-of-Way (ROW) Permits for all public road crossings. The PIRATE Rail Line is expected to cross four existing or under construction public roads; Pecos Road, Sossaman Road, Ellsworth Road and Signal Butte Road. It will also cross two future public roadways which have yet to be constructed; Crismon Road and Merrill Road. Within the ROW Permit Process, Union Pacific will coordinate with multiple City Departments, who will perform comprehensive reviews of Union Pacific's plans to ensure that City standards are met. In conjunction with ROW Permit approval, Union Pacific must submit for Building Permit approval to authorize the construction of the project. This involves coordination and reviews by the City's Development Services, Building Safety, and Fire & Medical Departments. Union Pacific will also be acquiring a portion of property on one City-owned property (Parcel APN#304-61-021B). This acquisition will be facilitated by the Real Estate Services department, and will require City Council approval.
