RECOMMENDED THAT THE BOARD: 1) REMOVE THE SECTION 106 CONDITION THAT WAS IMPOSED IN ITS JUNE 12, 2020 DECISION; AND 2) REPLACE THE SECTION 7 CONDITION IMPOSED IN THE SAME DECISION WITH A NEW CONDITION REQUIRING CSX TRANSPORTATION, INC. TO IMPLEMENT THE MITIGATION MEASURES RECOMMENDED BY THE U.S. DEPARTMENT OF FISH AND WILDLIFE.
