DECISION FOUND THAT SANTA CRUZ COUNTY REGIONAL TRANSPORTATION COMMISSION (SANTA CRUZ) WOULD NOT BECOME A COMMON CARRIER IF IT ENTERS INTO THE PROPOSED AGREEMENT WITH A NEW OPERATOR TO PROVIDE FREIGHT RAIL SERVICE OVER A LINE WHERE SANTA CRUZ OWNS THE PHYSICAL ASSETS.
