DECISION: (1) FOUND THAT THE METROPOLITAN TRANSIT AUTHORITY OF HARRIS COUNTY, TEX. (METRO) DOES NOT HAVE, AND NEVER HAD, THE RIGHT TO RESTORE RAIL SERVICE OVER A RAIL-BANKED RIGHT-OF-WAY, AND THE DECISION THEREFORE ALLOWED FORT BEND COUNTY TOLL ROAD AUTHORITY (FBCTRA) TO WITHDRAW ITS REQUEST TO ACQUIRE THAT RIGHT FROM METRO; AND (2) THE DECISION ALSO GRANTED A REQUEST TO SUBSTITUTE FBCTRA FOR METRO AS THE TRAIL USER ON THE RAIL-BANKED RIGHT-OF-WAY.
