DECISION ISSUED A DECLARATORY ORDER TO REMOVE UNCERTAINTY IN THIS MATTER, PURSUANT TO A PETITION FILED BY THE WISCONSIN DEPARTMENT OF TRANSPORTATION (WISDOT). THIS DECISION ALSO FOUND THAT WISDOT'S PROPOSED ACQUISITION OF THE ASSETS OF AN APPROXIMATELY 10.95-MILE SEGMENT OF RAIL LINE DOES NOT REQUIRE BOARD AUTHORIZATION UNDER 49 U.S.C. 10901 BECAUSE THE TRANSACTION COMPORTS WITH MAINE, DOT-ACQ. EXEMPTION, ME CENTRAL R. CO., 8 I.C.C. 2D 835 (1991) AND ITS PROGENY.
