(1) HOLD IN ABEYANCE THE REQUEST FOR ISSUANCE OF A NITU AND FOR ISSUANCE OF A PUBLIC USE CONDITION PENDING COMPLETION OF THE OFA PROCESS. IF THE OFA PROCESS TERMINATES, A DECISION WILL BE ISSUED TO IMPOSE THE NITU AND A PUBLIC USE CONDITION, (2) DIRECTED CONRAIL TO PROVIDE KOVC WITH FINANCIAL DATA AND INFORMATION TO ENABLE KOVC TO FILE AN OFA, AND (3) POSTPONED THE EFFECTIVE DATE OF THE EXEMPTION UNTIL 6/20/98.
