The railroads operate under an over 100 year old (interstate commerce act) accommodation awarded by state and federal governments that virtually gives them a right-of-way to any operations that expands and disrupts the surrounding communities. The STB, EPA, Congress and local governments have very little to zero jurisdiction over the railroads so the affected cities end up getting lawyers to fight it legally. But a legal fight is almost always fruitless as the railroads have unlimited funds to beat back any opposition to expansion and the 19th century government protections are on their side.
