As stated in the Draft Environmental Impact Statement, Under the Interstate Commerce Act, as amended, the Board “shall approve and authorize a transaction” such as this when, after considering several factors, “it finds the transaction is consistent with the public Interest.” 49 U.S.C §§ 11324 (b) & (c). How can the transaction be consistent with the public interest when the public at large has little to no awareness of potential corporate mergers such as these that pose a severe threat to their property via environmental deterioration and their modes of transportation. I only developed awareness of this transaction because of my heightened concern and research into corporate impact on the environment. I strongly encourage the board to take into consideration that these comments (assuming most of them do not support this acquisition) likely represent what the public at large, (the public interest) would feel if they had the awareness and opportunity to voice their concerns.
