(printed as 4/8/2008)CommentThe Bureau of Waste Management(BWM) would like the K & O or known by WATCO here in Kansas submit a work plan describing how they plan on disposing of railroad ties which have been left by them or their contactor(s). We view the way they have disposed of the ties as Illegal Disposal of a solid waste. K & O have left thousands of waste ties in the tree and brush permited site of the town of Jetmore in Hodgeman County from this abandonment. We have other areas where they have left ties which are waste ties. At this time we are in discussions with K & O or WATCO with waste ties they have left on private land in 2005 in Butler County. The Bureau of Waste Management is asking the Surface Transportation Board for assistance on this abandonment. The waste ties should be properly disposed at a permitted facility. Please have K & O submit to the BWM copies of receipts showing the waste ties were properly disposed at a permitted facility. We ask that all abandonments conducted by K & O be subject to these conditions to assure the citizens of Kansas that proper stewardship of our environment is maintain by all conduct business in the great state of Kansas.Bob Medina · Topeka, Kansas

(printed as 11/26/2007)CommentI work for the Bureau of Waste Management. We do all the oversight on hazardous and solid waste within Kansas. We have written the STB over our concerns on the proper management of the abandonments in Kansas. Since we have talked and you have included my name in the process we continue to have problems with some railroad companies and their contractors. Recently we had one contractor from V & S Railway illegally dump approx. 10,000 waste ties into a creek. We need to have each railroad company send the Bureau of Waste Management and Bob Medina notice on how All railroad ties and other waste will be manifested to a proper disposal facility. Please, have all companies send me this notice directly indicating the following: when action will take place, where, who the contractor is and a contact person with phone number, copy of receipts no less than 45 days after work is completed where ties and other waste was properly disposed. They may send other state of Kansas agencies notices concerning their activities but, this Bureau is the only one which is responsible for the proper disposal of all waste from each and every abandonment or repair work conducted within Kansas. We seem to have some confusion on who needs to be informed. I received this information from the Bureau of Water. This same information needs to be addressed with my name and Bureau to assure all companies conducting work within Kansas may stay in compliance with all state and federal statues and regulations. The Bureau of Waste Management appreciates your help and cooperation keeping our state and the environment safe for its citizens. (printed as 5/19/2006)CommentThank you for including the Bureau of Waste Management in your comments. The Conditions part 1. ask for K & O to send comments concerning NPDES requirements. The Bureau of Waste Management regulates Solid Waste Issues for the state of Kansas. We would like to include: any salvage activities shall comply with all state Solid Waste Statues and Regulations concerning the proper disposal of all railroad ties. We would like to see documentation of ALL Railroad Ties within the state. We are concern with the Illegal Disposal of Railroad Ties where contracters in the past have left hundreds if not thousands of railroad ties on private properties. These ties then become an environmental nuisance and we view this type of disposal as Illegal Dumping. We need to make it clear to all companies the proper management of railroad ties does not mean to find a landowner in the area to dispose of these ties. We are working with Union Pacific at this time cleaning up sites where contractors in the past have dumped thousands of railroad ties on private landowners and now they have become an environmental threat to the surrounding community. Requiring proper documentation to our Bureau will ensure this practice does not continue in the state of Kansas.
