The abandonment anticipated in STB's Environmental Assessment has no impact on the residents and neighborhood adjacent to the Harsimus Cove Embankment. Reuse can not be determined and should not be a consideration. The requirements contained in the STB's Environmental Assessment provide adequate review and protection. Going forward, control and approval of the Embankment use after abandonment is the responsibility of local boards and agencies, supported as needed by state and federal development related agencies. There is no reason for the STB to be involved. Sufficient Public participation in the impact of abandonment is assured in the required Section 106 of the National Historic Preservation Act review. Support for a full EIS is not found in precedent of law for Out of Service" abandonments and should not be where all the railroad "equiptment" was removed many years ago and the the line has been out of service for over a decade."
