Our office has been contacted by the Idaho Transportation Department about the proposed recreation trail. If this recreation trail project is undertaken it would have the potential to affect historic properties. For the STB to be in compliance with Section 106 of the National Historic Preservation Act (as outlined in § 36 CFR 800), a cultural resources survey must be conducted to identify and evaluate historic properties that may be affected by the project. This would include documenting all buildings or structures that are 45-years of age within the APE (e.g. steel truss bridge and plate girder bridge). Work will need to be conducted by a 36 CFR Part 61- qualified architectural historian. This work is required by the Surface Transportation Board (STB) per § 49 CFR 1105.8. The current undertaking would deviate from the ability for the EIRR to not "alter the historic integrity of all historic properties including sites, buildings, structures, and objects within the project right-of-way" as mentioned in decision 50163.
