In reference to: Docket No. AB-1292X Eastern Idaho Railroad, L.L.C. --Abandonment Please see the attached letter from our office. In addition, it should be noted that to comply with Section 106 of the National Historic Preservation Act, STB must take into account a project's undertakings on historic properties. Per 36 CFR 800.5(a)(2)(vii), the Transfer, lease, or sale of property out of Federal ownership or control without adequate and legally enforceable restrictions or conditions to ensure long-term preservation of the property's historic significance." The railroad spur and the two bridges being transferred will need to be evaluated and assessed for listing in the National Register of Historic Places."
