Comment EI-34385

Received or sent (printed as 9/21/2026)

CapMetro is the Owner of 162 Miles of Short Line Railroad with Critical Connections to UP and BSNF in Central Texas; all critical freight transfer points to/from the CapMetro short line occurs at an UP controlled interchange that is central to the 162-mile line, which includes BSNF trackage rights to and from the interchange. CapMetro requests that the UP/NS merger not impact the existing connections in Central Texas to the UP mainline nor preclude the ability for potential re-connections to/from additional rail connections to the UP line on the eastern subdivision along the CapMetro rail line. The UP/NS merger should also not preclude the potential for additional rail traffic (through improvements or by other means) to and from the existing and any future connection to UP to facilitate future revenue opportunities through additional capacity to meet latent and future demand to/from the CapMetro short rail line. Future demand could include freight and passenger demand, and potentially intermodal center/economic opportunities along the entirety of the rail line that will benefit both UP and CapMetro and the future of rail growth in Central Texas.
