Based on its review, DNREC's Division of Air Quality (AQ) recommends that STB quantify and evaluate the air-quality impacts associated with the projected increase in activity at the Edgemoor rail yard, including transaction-related locomotive, rail-yard, and related emissions within New Castle County. AQ also recommends that STB evaluate whether the anticipated increase in emissions is consistent with the applicable provisions of Delaware’s EPA-Approved SIP, as codified in 40 CFR Part 52, Subpart I, pursuant to 49 CFR § 1105.7(e)(5)(ii). AQ further recommends that STB evaluate the applicability of General Conformity under 40 CFR Part 93, Subpart B, including the reasonably foreseeable direct and indirect emissions associated with the proposed federal action in New Castle County. AQ requests continued coordination with STB’s Office of Environmental Analysis throughout the NEPA review process and the opportunity to review and provide input on relevant air-quality and conformity analyses as they become available.
