To Whom It May Concern, Upon reviewing the figures presented by Texas Materials regarding their proposed railway, it is clear that their math is fundamentally flawed and significantly misrepresents the extent of eminent domain required. Their attorney’s claim of “about 20 miles of original ROW” is incorrect. There is only 9 miles of the project existing Texas Materials Group right-of-way (ROW), while the remaining 17.9 miles (approximately two-thirds of the project) consists of privately owned land that would need to be acquired through eminent domain. This directly contradicts any assertion that the project will have minimal impact on private property owners. The majority of the route would require forcibly seizing land from citizens—displacing families, devaluing properties, and infringing on private ownership rights. Furthermore, the misleading math appears to downplay the scale of disruption this project would cause. By excluding key privately owned sections, Texas Materials distorts the reality of the situation. Their proposal hinges on inaccurate calculations that minimize the true footprint of land acquisition and the number of affected property owners. In light of these discrepancies, the project should be re-evaluated with accurate and transparent property impact data. Proceeding with faulty information not only misleads the public but also undermines the integrity of the review process. We strongly urge the Surface Transportation Board and relevant authorities to reject this proposal based on its flawed and misleading presentation of land acquisition requirements. Thank you,
