Thank you for listening to citizens' concerns (Maverick County Texas) regarding proposed Puerto Verde LLC Green Railway project. In addition to concerns already submitted, there are added concerns. In a strategic move, designed to circumvent the will of citizens in Maverick county, there has been an attempt to create a Puerto Verde Port authority, giving Puerto Verde LLC power/authority to levy taxes, create its own water district, and have eminent domain authority. (HB74 in Texas House; stalled at Transportation Committee in Tx Senate). All with the intent to have absolute control/no accountability to taxpayers or elected officials at the local city/county level. IN ADDITION, Maverick County citizens are concerned about ACTIVITY AROUND THE TRANSPORTATION OF HAZARDOUS MATERIALS and possibly fuel (huachicol). There is information floating around Maverick County regarding the illegal transportation of stolen fuel. Owner/Director of Puerto Verde, Ruben Garibay, owns and operates semi-trucks exclusively with Mexican drivers who use B-1 visas. Recently approximately 160 tanks labeled "hazardous materials" (IN SPANISH) have been observed and photographed, on his property called Venado Grande ranch, on highway 277 near the Maverick County airport. Puerto Verde/Mr. Garibay have assured Maverick County citizens that they/he would be transparent regarding strict adherence to EPA regulations and safety concerns of citizens regarding exactly the transportation of hazardous materials. Yet, no one knew he was already transporting these types of materials. While he may have been granted permits, he has not been transparent with taxpayers. (See attached images) We request you please continue to research impact HB 74 would have on Maverick County residents if the Puerto Verde Port Authority is created, and that you please use the power and authority of your committee to investigate the grand and sweeping activities into which Garibay is involved.
