Recently, counsel for the Town of Brookhaven submitted to the Board a copy of Resolution 2023-286, Adoption of the SEQRA Negative Declaration in connection with the proposed Brookhaven Rail Terminal (BRT) Expansion (n/k/a Brookhaven Logistics), and related materials designated by OEA as EI-32837. The Resolution notes that copies were sent to STB Chairman Oberman. It is unclear why a copy of the Resolution was sent to Chairman Oberman. The Resolution was filed/posted as part of OEA's Environmental Correspondence in FD 35141, FD 35819, FD 36398, FD 36399, and FD 36399-1. In response to this submission, and to ensure that the record is complete, please find attached to be filed/posted in the same dockets the Verified Petition/Complaint filed in In re: National Association for the Advancement of Colored People et al. v. The Town of Brookhaven et al. No 611105 (S. Ct. Suffolk Cnty. 2023) (Complaint filed May 2, 2023) challenging the Town's approval of Resolution 2023-286.
