From: Dan Kloos <dan.kloos@cjerickson.com> To: Phillis.Johnson-Ball@stb.dot.gov" <Phillis.Johnson-Ball@stb.dot.gov> Date: 06/03/2016 02:41 PM Subject: GLB RR & Frank Patton Waiver Phillis Johnson-Ball I have been reading through the information that is available and I am wondering how it is that a waiver was given to Mr. Patton and his railroad to sidestep the standard requirements for a project like this. This waiver allowed Frank Patton to avoid responsibility for the fact that his plan is not legitimate, it is devoid of details, material facts, and he constantly misrepresents it by directly contradicting himself and others associated with GLBT. I have seen that there are now two of the largest railroads in the area that want nothing to do with this railroad bypass so is this really a proposed railroad or is this a front for something else and Mr. Patton and his “investors” are lying to you and the rest of us. I am in the final stretch of building a brand new home that I have worked very hard all my life to be able to afford and one week after I started I was blindsided with the information that this railroad will be within 200 feet of my new home. It appears to me that MR. Patton and or his investors must have the ear, arm or bank account of someone that was able to “fast track” the project and skip all the required steps. The railroads have already told you and others involved in this that they have their own systems in place that they are upgrading and changing to relieve the congestion. These people are legitimate railroad people with many years in this industry and they have stated they will not use this bypass and that there is no need for it. Do not hesitate to contact me to discuss further.
