July 11, 2016 GLBT -FD 35952 would be Life Threatening To Our Sons Health Land owners are entitled to quiet enjoyment of their land; a right to undisturbed use and enjoyment of their property. The common law tort of private nuisance provides a basic for liability when an activity interferes with a landowners use and enjoyment of their land. An interference may be found if it constitutes a private nuisance and it create SIGNIFICANT HARM! The GLBT is proposed to pass behind our house and would be life threatening to our son! Two years ago he had spontaneous pneumothorax which is bubbles forming on top of his lungs breaking and causing them to collapse. In his case, he had both lungs collapse and therefore he ended up having 2 major lung surgeries in which titanium staples were placed across the tops of both lungs. He will lead a full long life as long as long he never smokes, not exposed to 2nd hand smoke, or any other damaging pollution for the rest of his life or bubbles could form again. This would be life threatening should this happen and there is nothing more medically they could do! His doctors have advised him to avoid being exposed to any pollution to his lung so this will not happen! This is impossible if the train passes in our backyard! The pollution of the 110 trains would cause SIGNIFICANT HARM to our son and we would be forced to move from our historic home and farm in which we own and have raised our family their entire lives by the GLBT to save our sons life!
