From the legal definition of eminent domain: The power of eminent domain was created to authorize the government or condemning authority...to conduct a compulsory sale of property FOR THE COMMON WELFARE, SUCH AS HEALTH OR SAFTY." This project is neither intended for the common welfare nor the public health or safety!!! and eminent domain should not apply to this project!!! "To exercise this power, the government must prove that the four elements set forth in the fifth amendment are present:(1)private property (2)must be taken(3)FOR PUBLIC USE....." The public in the affected area will not have any use for this project whatsoever!!! "Property value may be reduced because of noise, accessibility problems, or other agents" Property value will definitely go down in the area, creating a lose of revenue to all township, county and state coffers due to lower tax rates. "The third element, public use, requires that the property taken be used to BENEFIT THE PUBLIC RATHER THAN SPECIFIC INDIVIDUALS" This project only benefits a handful of investors and has no benefit at all to the land owners or the counties that it passes through!!! "Generally, the best use of the land is considered to be its use at the time it was condemned, even though the condemnor might not intend to use the land in the same manner as the owner" For these reasons, and a hundred others, I ask that you deny GLB's request for a railroad through northern Illinois!!
