THE DECISION FOUND THAT THE TRANSACTION WOULD NOT CAUSE WisDOT TO BECOME A RAIL CARRIER AND WOULD NOT REQUIRE BOARD AUTHORIZATION UNDER 49 U.S.C. § 10901, OR AN EXEMPTION UNDER 49 U.S.C. § 10502. IN ADDITION, THE DECISION FOUND THAT THE TRANSACTION WOULD COME WITHIN THE PURVIEW OF THE 'STATE OF MAINE' LINE OF PRECEDENT AND WOULD THEREFORE NOT BE SUBJECT TO THE BOARD'S AUTHORITY.
