November 29, 2010 Surface Transportation Board 395 E Street, SW Washington, DC 20423 Attention: Danielle Gosselin Section of Environmental Analysis Environmental Filing FD 35116 RE: Environmental Filing FD 35116 Dear Ms. Gosselin: I am providing additional information in regard to my earlier comments submitted September 28, 2010. In my September 28 letter I referenced an agreement between Snow Shoe Township and Resource Recovery, LLC (RRLLC) in which RRLLC agreed not to use Gorton Road, the No-Build Alternative (Local Road System Upgrade), for trash hauling. In his letter of October 26, 2010, Mr. Charles Suhr of Stevens & Lee stated this agreement was terminated. In January 2009 the Snow Shoe Township Supervisors sued RRLLC for terminating the agreement. This lawsuit is pending and will not come before the court until February 2011 (see attached). The outcome of this lawsuit may be relevant to the legitimacy of the No-Build Alternative (Local Road System Upgrade). Respectfully, JoAnn Gillette
