Acting Secretary Surface Transportation Board 395 E Street, SW Washington, DC 20423 RE: Finance Docket No. 35087 Dear Secretary Quinlan: As a retired CN (former IC Railroad) employee with 41 years of industry experience, 10 years within the Chicago Terminal while living in Crown Point, Indiana, it’s only appropriate to explain my position on the proposed CN acquisition of the Elgin, Joliet & Eastern Railway in northeast Illinois and northwest Indiana. Prior to retirement, I was not only responsible for reviewing service issues with our Chicago-area customers and working to resolve those issues, but also proposing changes that would improve productivity and reduce congestion within the Chicago Terminal. Congestion within the Chicago Terminal area and beyond has been an industry challenge for many years and the proposed acquisition would significantly impact that problem. Customers will benefit immediately from the acquisition with better service. Taxpayers will not be asked or required to invest any money in the project since CN is responsible for all expenses involving the acquisition, maintenance, and any upgrades of properties. It will reduce the number of rail cars that must be switched within the Terminal plus reduce fuel use as well as the normal pollution that goes hand-in-hand with this extra handling. Efficiency of the freight rail system should be the number one priority of the Board. I strongly urge you to finish your work on the environmental impacts and approve this transaction quickly. This is one of the best offerings for surface transportation and it makes sense for the country. Regards, Larry Kyle
