Van Poucke 833 Rockbridge Drive Naperville, Illinois 60540 September 30, 2008 Phillis Johnson-Ball, Section of Environmental Analysis Surface Transportation Board 395 E Street SW Washington, D.C. 20423 Dear Ms. Johnson-Ball: I am writing regarding the environmental concerns relating to Finance Docket No. 35087, CN's acquisition of EJ&E rail lines. Comments in the draft EIS appear to simply recommend that CN not be required to pay for mitigation— especially for grade separations and sound/vibration mitigation measures— because railroads have not been required to do so in the past. However, that is not really an adequate response. The transaction has real costs to the people that live near and cross over the EJ and E. If CN desires to complete this transaction, it should be required to absorb the costs imposed on those effected individuals. The CN proposal will result in efficiency and savings for CN, but shifting a financial and lifestyle burden to others. Residents of the area are, in effect, subsidizing the transaction though added financial costs as well as a reduction in their standard of living due to the outward environmental costs—noise, vibration, increased traffic. We ask that the STB deny this transaction in its current form, or, in the alternative, condition the proposal on adequate mitigation and require same in the FEIS. Sincerely, Michael J.
