On June 12, 2006, the Texas Commission on Environmental Quality (TCEQ) requested approximately 70 separate supplmental information items from Vulcan regarding its proposed Water Pollution Abatement Plan (WPAP). On June 28, 2006, Vulcan's consultant provided a response to TCEQ approximately an inch to an inch and a half thick, containing significant new information relative to the original WPAP, including several new and revised table-sized maps of the quarry site and its drainage plan, and statements that pertain to groundwater impacts and/or purported impact avoidance measures. TCEQ has recently advised my clients of the availability of the new information, but has not indicated whether it plans to proceed or reopen the comment period on the WPAP. For the purposes of the rail licensing proceeding, we urge STB-SEA to request this new information from the applicant, if it has not already been provided, due to its relevance to the ongoing impact analysis.
