BSNF suggests that the Section 106 condition of the National Historic Preservation Act, 16 U.S.C. 470f, does not need to be imposed, based on information in a letter from the State Historical Society of North Dakota (the State Historical Preservation Officer or SHPO). Attached is the May 12, 2004 letter from the SHPO that states that no historic properties will be affected by the abandonment. However, the SHPO also requests the site forms and the final report from BNSF.
